"1.Contract- Attached is the one and only contract which was signed and agreed to. They claim that there a few different ones and that is incorrect, those were quotes during our negotiation process. They signed this contract 5/22/23 . The total was for $75,000 [ it was supposed to be $80,161.19] but I gave them a discount. They have copies of three checks for $18,250 totaling $54,750.0 There is a $20,250 balance in the contract outstanding 2.Pavers- you see in the contract where it states paver removal, never once does it mention , grading, cost of material, or paver installation. All other add ons were clearly marked. 3. In Lieu- We had agreed to do the pavers in lieu of the bathroom. Even though they are professional college educated individuals they stated they did not understand whatin lieu meant as they agreed walked through the proposed changes and agreed with to Not do the bathroom install. 4. I did extensive additional work inside while Mrs Zaheer was ill as a gesture of goodwill, I even spent all day cleaning for her post surgery, and every time she told me her grandson was coming for a visit we stopped the crew per her orders and pressure washed the entire site. 5. They are currently hiding various paver pallets, and are refusing to pay for the in lieu work. 6. During an unprecedented invitation we agreed to meet at the DBPR a 2nd time even though they refused us entry onto the site , that by the mediation agreement we were to have access until 4/30 and were very close to finishing when the did not allow us on the premises the last week and called the police for no reason, Inspector field and I were completely baffled by that. We met at the DBPR for a 2nd time 2nd meeting agreement was that we were to finish by Dec 20th if the agreed to place the money in escrow and agree to pay us when we finished, and allow us to exchange the two windows we wanted to change.. They said they agreed then email the day before we were to go out to say they were not willing to place the money in an escrow or allow us to exchange the windows . ( to what end other than to not pay and hinder the process would that be. 7. They called TEMO with tortious intents asking them to tell us to finish for no additional. TEMO suggested we not do the project unless the client would be willing to sign a paper that they would pay in full upon completion, again they refused. If they are truly genuine about wanting us to finish the project and paying us, then we stand by the following way forward. 1. Agree to pay in full upon finish. 2. Allow us to exchange the 2 windows that need to be changed. 3. Pay for the additional work they requested along the way. 4. Allow the workers unfettered access to their back yard to finish the work 5. Stop maligning and misrepresenting the chain of events that took place. 6. It took their HOA over a year to approve the addition 7. The city did not approve the tempered glass TEMO had and we had to change the engineering, and they would not allow the walls to be the Sunroom kit walls so we had to build it out of traditional construction, brick and mortar, I did not charge them the price difference, even though there was a CONSIDERABLE COST DIFFERENCE TO US. At every turn that we have been nice and gone above and beyond they are ungrateful."
