Initially my experience was Great up until our scheduled start date. I will start by saying we we paid our deposit and 50% down (totaling $49,776) prior to starting excavation only to receive a text message on New Years Day asking for an additional $15,000 which we did not pay. All this before work had even started. Start date came and went . We were told he did not have an excavator. Then we were told equipment would be dropped off that day, then we were told a crew would be there the following Monday, then we were told he was coming himself. All NO SHOWS and No Communication, which communication was great up until start date and writing him a check. This went on for 2 weeks. Finally it was agreed upon he would refund our money and apologized profusely. My husband went to his place of business where he said a cashiers check would be waiting, again another example of his words not aligning with actions. He did write my husband a check and we were told days later funds were available and we cashed the check. Insufficient Funds. We then spoke with him and were told funds would be wire transferred the next morning first thing when the bank opened. Nothing and again no communication. I am at a loss as we trusted him and are now without a pool and $50,000!!! I have contacted the District Attorney in Lubbock and am now perusing that route. I am so frustrated! A step I was forced to take as I cannot get a hold of him and my assumption now is this is criminal.
