"Matt, you booked the job, correct? You did not cancel accordingly to our agreement, correct? Please understand you are liable to any contractual billing if all of the below apply: - You specifically requested we come out to quote ASAP. -You scheduled the job immediately as an emergency. -You agree to pricing and agree to perform the job immediately. -You request first hour times to schedule or next day morning 1st job. -You do not correspond to phone calls prior to crew dispatch. -You do not respond to crews once they arrive at you residence. -You fail to certify a real reason to cancel once crew has been to your home and you failed to respond. In other words, your motive for canceling without due notice, due legitimate reasons and not corresponding appropriately, once job was scheduled and crews showed, places you liable to pay. Specially if you placed the job as an emergency. For your future information: You should know that if any contractor touches any job he is liable to perform said to its full work scope levels of performance, state law. Also, you should know that not believing in our recommendations, or any licensed contractors recommendations, is not reason enough to cancel any job under contract, even if verbal. Asking for time to a second licensed contractors opinion is. You friend is not a licensed contractor, you mentioned, nor did he specify a better alternative solution. We are reputable sir! We stand behind our work. We follow state regulations. Note: State Law reasons that should any contractors recommendations fail he owns the mistake at full restitution to homeowner-s. Let us ask you, do you seriously believe we would chance owning a $2,800 door over it not working on a $280.00 job remediation recommendation? No sir, we would not! The gentleman who visited you in your home is an Architect with over 25 years construction field experience. He is seasoned, sir! You mentioned to have spoken to your friend immediately after the estimator left, correct? Why did you not inform of the cancellation then? Why did you fail to answer calls early morning at all our attempts? Your response was: I was busy and did not feel obligated to answer since I texted you company late last nigh. With all due respect, you are liable, specially if you do not pick up your phone calls to your direct cell."
"I feel it is fair you understand our frustration here. We agreed on an hourly rate. We also agreed on painting your bathroom ceiling, fixing your bamboo wallpaper by gluing it down and to replace exterior lights. We agreed on 3 hours at $350.00. Once Alfredo arrived you told him to paint your kitchen ceiling, totally different than your bathroom ceiling and 6 times the size. A job during my visit you mentioned not being sure about doing. I did mention it could take 4 to 5 hours and would cost $550.00. You said: "Why don't we hold off on the kitchen, for now. I was not sure it would cost that much. I will just do the bathroom. In the event, I change my mind when you come, I will let you know." I am very precise on labor times to complete job scopes. My pricing quotes are very accurate. FYI: I am an Architect. I started as a take-off construction supervisor. I know exact times and exact materials any work scope task inside the construction industry can consume. Yes, we both know the difference from a kitchen ceiling to a bathroom ceiling pricing, correct? You claim there is miss communication! I am very meticulous about correct communication. I was clear to say: I am specific to communicate with all crews prior to job commencing. I insist they call me once they find changes to work orders. Alfredo did communicate. Several calls were made to you. Alfredo communicated with you that the information to work order was different. You persisted to not answer my calls. You insisted to tell Alfredo that I knew it was the kitchen ceiling. Several attempts were made to call and speak to you. Not able to speak to you, I made sure the painter-owner, Alfredo, communicated factors over to you. I requested him to stop the job. I called Alfredo back and he assured you had agreed to pay the difference. I agreed to have him proceed based on your direct verbal confirmation to him. You were billed correctly. Marcy, please allow me to ask you this: Was it me or was it you that did not want to settle the bill face to face when I was there at your home? I was sure to mention the amount at your home while you inspected the lighting. Instead of paying then, you said: please send me a corrected invoice and I will mail you a check. Eight weeks after the job was done no check, nor any phone calls from you. You claim an email was sent to us. I found no record of it. FYI, numerous attempts were made to contact you, in view of the bill. I am not in the business of surprising clients. My exact words to anyone who does business with us: We are not a construction material retailer, nor do we charge extra for materials. All material costs are passed to the client at wholesale or retail cost from our business accounts. We charge most handyman jobs by the hour. We charge select skilled labor by the hour or by the job, depending on the scope of work. All quotes are estimates. All quotes can change if additional work is requested by the client, or: unforeseen circumstances"
