Over charged for the work.

Project: Repair or Service a Water Heater - For Business
I hired him to repair a hot water heater, after replacing part the hot water heater still did not work, He wanted to charge 365 to fix hot water heater, I agreed, but the hot water heater is not working.
Response by Mainline Plumbing, Inc.: It's unfortunate that your water heater isn't working. The technician explained to you that the part may not permanently fix the issue. This was disclosed to you. The technician also explained that you would be credited back the 365$ toward a new water heater if the part didn't permanently fix the issue. To all of this you agreed and signed a contract as well. Last but not least you haven't paid any money thus far for our services.
