I entered into a contract with this firm for the renovation of a small bathroom. The contract provides: The Contractor shall be responsible for obtaining any and all necessary permits, approvals, easements, assessments and meeting other legal obligations for the development of real estate, use or occupancy of permanent structures or for permanent changes in existing facilities. I paid an initial deposit of $3,687.50, as called for in the contract. I also paid the fees ($340.24) required to obtain a building permit. The contractor applied for the required building permits. The Building Department disapproved the application for numerous reasons, including the failure to: provide a floor plan, sufficiently describe the physical alteration, explain the scope of the plumbing and electrical work to be done, and provide necessary plans and drawings. The firm advised me their permit application had been disapproved and that they would need to retain the services of an architect to write detailed plans, at an additional cost to me of approximately $2,000. The contract specifically imposed responsibility for obtaining permits on the firm, so I declined their demand for an additional payment. In addition to ignoring their contractual obligation, the firm also misrepresented the need to obtain an architect. The Building Department does not require an architect for every bathroom remodel. Any competent contractor should be able to write an acceptable permit application for a simple bathroom renovation. This firm, however, refused to obtain the necessary permits without an additional $2000 payment for an architect. Since the firm would not do the work they contracted to perform, I asked them to rescind the contract and return my deposit. The firm agreed and advised me that their accounting department would be advised to issue the refund. The rescission of the contract and promise of a refund were confirmed in writing. After more than a month of delays, phone calls and emails, I finally received a check from the firm for $1,000, marked Partial Payment. I advised the firm that a partial payment was contrary to our confirmed agreement to rescind the contract and unacceptable. The firm then wrote that it was willing to refund only 75% of the amount due. The owner promised to send another check later the same week. Despite the owner s assurances that a check was forthcoming, I never received a second check. The firm has done no work. The firm failed to even obtain a permit. The firm refused to refund the deposit I paid despite repeated promises to do so. As a result, I have been compelled to file a claim with HomeAdvisor. HomeAdvisor has contacted the firm repeatedly, but the firm has not responded. I must now pursue arbitration or a lawsuit for breach of contract and return of my deposit.
