"In regards to the complaint against us from Kyle and Jessica Fratz, I would like to address the issues he has accused of. First, we did complete the project and did not get paid before we left. Mrs. Fratz gave us the final check about 30 minutes before we left as we were finishing cleaning up. She has an infant who was to be napping and did not want to be disturbed so she went ahead and gave it to us. I actually praised the guys for this being one of the cleanest job sites. There was very little damage to their sod as they claimed to the BBB. As with any driveway tear out some damaged sod is to be expected.. Our guys did a very good job cleaning up and did not leave them a mess as they stated. The dimensions were changed but was discussed with Mr. Fratz over the phone since he was out of town attending a funeral. We could not extend the driveway as far out as he wanted because his brick mail box would have been included in the area to be poured. Mr. Fratz told the BBB that we were supposed to move the mailbox but that was never discussed and was not a part of the contract. Since we could not extend the driveway out as far as they wanted we would form and pour a sidewalk leading from the driveway to the front porch. Mr. Fratz agreed to the change. As to the poor quality of the stain, it is the color they chose. We always try to talk our customers from using this particular stain because in our opinion it just doesn't a very good look even after two coats of it. When we arrived the day after tearing out the driveway we all noticed a large amount of water standing in the driveway apron by the road and there was water running out into the road as well. From my personal experience with having a sprinkler head by my driveway, I assumed it must be a bad head and leaked when the system was ran the night before. We already have some irrigation supplies on our work trucks just in case a line is broken it can be fixed immediately so I replaced the head thinking this would take care of his leak. The night before we were to pour we asked Mr. Fratz the run his entire irrigation in his front yard to make sure there was no leaks and everything was running as usual. I will attach a signed statement from Mr. Fratz stating he did so. I never told Mr. Fratz that I would be filing a claim with my insurance company. I had already received a call from my insurance agent who told me that either Mr. Fratz or his attorney had called them and he already told them that they did not have a claim to file based on what was told to him. We did make several appointments to go back and try to make the stain look better and to address the other complaints and got rained out each time. After several times of rain creating delays Mr. Fratz started threatening us with his attorney. At that point the entire situation has turned hostile and we did not feel comfortable going back on to Mr. Fratz property."
"At this time, Home Advisors has closed out this complaint with no blame to either side as there is no evidence to prove who created the damage to the customers property. The Better Business Bureau came to the same conclusion. We stand by our belief that we did not damage the building as we had some one supervising the tractor work just to prevent this exact thing from happening. There are many false statements in the customer's complaint. We did have conversations with the customer regarding the damage and at that time he cancelled the rest of his job until he had a resolution in regards to his claims we damaged the property. At that point we did start on the neighbors driveway. We normally have it stated in our contracts that half of the money due for the project is paid up front and this does cover the costs of materials and concrete. Also, we never ask for the remaining balance due until the customer is completely satisfied with our work. The customer claims that to repair the three damaged panels the costs would be $3,350. $2,150 of this amount was for shipping fees for the panels to be delivered from Tennessee to our location. However, after researching these costs through conversations and emails with the company shipping the panels here, we found out that that cost was not correct. The customer was very untruthful based on the fact that they could actually be shipped here for absolutely no costs. Once they got to Florida they could be picked up for free by the customer or the company could delivery them to his home for approximately $200. We believe that the customer had damaged his building with his own tractor and was trying to lay blame on our company to have it repaired. The costs for the materials needed to repair his building are less than $500 but he was asking for $3,350. Since the customer was not quite honest about the costs of repairs we don't feel he is being quite honest about who might of damaged his building."
"First, this job was done in November 2105. In March 2016 Daniel contacted Home Advisors complaining about the placement of the studs. Our company mediated with Daniel and HA through a three way phone conversation. Daniel agreed that $1000.00 would cover the costs to have the studs placed properly. At the time of the mediation that was his only complaint. A promissory note was drawn up and Daniel received payment in full. The promissory note also stated that Daniel "will be satisfied with this resolution to his complaint" against our company. He states now that it actually cost him $3,500.00 to repair the damage but he is the one who told HA it would only cost $1000.00 and we paid him that sum. Also, Daniel had to sign a form from the concrete delivery company agreeing to let them drive their truck across his driveway. There is always a risking in doing so, but Daniel agreed to let them. That is not an issue our company can resolve. The foundation was actually level and did pass inspection. Daniel held our tools hostage in his locked garage until he had another company come out and confirm it was level and only then did he let us proceed. Lastly, as to the rebar, wire mesh and vapor, they were not listed in his contract for us to supply. Sometimes able customers like to do some part of the work to save money on our labor costs. I do have copies of our contract with Daniel and the promissory note but do not think it would be very ethical to copy and paste them here with his personal information. I am sorry Daniel is not happy but we did what he asked us to do almost a year and a half age to make his happy."
"As always we call a locate company to flag utility wires and cables. This area was not flagged by that company. We have emailed copies of the locate report to Home Advisor for review. We were never told of the irrigation system being damaged. We have an employee who formerly owned an irrigation company and we could have easily repaired Mrs. (consumer name withheld per their request.) system for no charge. As to the resurfacing, three different concrete trucks were needed for her driveway. The first pour will cure faster than the last one. Eventually, all the concrete will cure to about the same color. We never ask for a final payment until our customers are satisfied. If (consumer name withheld per their request.) was unhappy or needed something repaired all she needed to do was ask before final payment and we would have been more than happy to take care of anything she needed."
