Gilbert came to my home to give me an estimate for exterior paint and trim. I have two other estimates and he was professional and lower by a few hundred dollars. Two story home. 1700 sqft paint exterior and the trim, approx 2600 was his estimate. Right in the ball park with the others. He can’t give me a start date but wants 1/3rd down up front. I passed. Why? Not gonna pay someone for work not performed. He wants the business and asks for a good faith 10 percent. We agree but I tell him I’ll have the money on Monday. A week passes and he shows up on the following Monday. Never goes over the estimate with me, just flips to the back page where he puts he received the 260 and signs. He takes pics of the contract and we then look at the neighbors home across the street and I tell him that’s the color I want. He says he needs a paint sample to match but I tell him to just get as close as possible to the neighbors color. I explain they have the same kind of windows I’m putting in which he knew I was doing after I paint cause I asked him if I should replace the windows before I paint or is it ok to paint first. He explained how the new window frames will fit over my old frames and the paint will be below the frame so I’m good to paint before installing windows. Fast forward two days he wants to drop off samples and collect the remaining money before he starts. I explain to him I’m out of town and won’t be available until Monday. He then calls me two days later and tells me he will power wash the house and get started as soon as Monday. He then offers to paint everything for 1100 more dollars and I explain the inside is fine. He says no, the exterior stucco. Huh? 80 percent of my home is stucco. He then explains the 2600 contract is for the trim and eaves only. I laugh and tell him to not do any work, leave my deposit and we’re good. He says the estimate was trim only not stucco. That I need to read it and he’s keeping my deposit. He then tells me if I sue him he will counter sue me for a bunch of money and I’ll be sorry. Well 260 bucks isn’t worth my time going to small claims. He wants to rip me off then that’s on him. He scammed me. What’s laughable is I have the original estimate we both signed. The one he utilized white out on and filled in blanks that weren’t filled in when we first spoke. He never went over any of it the time he came for the deposit. It’s all on video. How is it all on video? We stood on my porch in full view of my security camera where it shows him flipping to the last page of his doctored estimate, shows us sign, shows us discussing the neighbors home, and yes, I have audio as well.Yeah I could have read the estimate line for line but didn’t have time. I saw the final amount was still the same as the first time we spoke. I assumed it was for what we discussed as the other estimates I have from other companies. Shame on me but in truth he’s the one scamming me. Glad I didn’t put out 30 percent down
Response by Western Pacific Painting Company: My Contract Is very clear and itemized by cost for each and every single thing we are going to paint. He told me he wanted only the wood trim painted so that is what I charged him for. Once we showed up to his house to start the pressure wash I mentioned to him if he was interested to paint the stucco as well I would be more than happy to give him a cost. He told me "What are you talking about? You are painting my whole house for $2600.00". Please keep in mind a two story house is not going to be painted by a licensed Contractor who pays employer tax and workers comp for $2600.00. Especially his house that has not been painted in 30 years.
