"All agreed contract dealings were conducted strictly between CertaPro Painters and Linells Fiduciary, Nicole Welsh. All work was performed as agreed contract. (member name removed) never contacted her Fiduciary, nor had she contacted our franchise directly either via email or phone or else we would have taken care of any issues as soon as possible. (member name removed) went directly to corporate with her false allegations that we had robbed her. We went above and beyond to accommodate (member name removed) and her financial situation by setting up a monthly payment plan. The homeowner waited till almost the end of the season to log her complaints and we were then fighting a rainy season. (member name removed) has not been accommodating, we had contacted her to set up a date and time to come out to the house and do the touch ups, when the painting crew arrived, they were told by (member name removed) son that she was sleeping and we were unable to access the yard. We then contacted her a second time to let her know we were scheduling to come out and to put the paint outside since she does not always answer the door, when the painter arrived, the paint had not been left out as instructed, the gates to access the yard were locked and she was not answering. The homeowners’ house does have a prior issue of the stucco siding holding in moisture, therefore, the repairs that were performed as per agreed contract were compromised due to this situation. We will continue to try and contact (member name removed) in order to rectify any issues as soon as the weather permits."
"As per the agreed contract, the homeowners project was to receive only one coat of paint on the fence and since we were applying only one coat, a Sherwin Williams product was used that is a paint and primer in one. It was unfortunate that one coat did not give the coverage the homeowner had envisioned. Therefore, CertaPro applied at company expense, a second coat."
"The first crew assigned to the project did come out and start to clean the ranch style house with ladders, a telescopic brush, cleaning products and a hose. The homeowner was not happy with that process or the assigned crew, so we immediately put another crew on the project and proceeded to power wash the house only. It is customary to paint a house one side at a time and CertaPro always uses a high quality, exterior, Sherwin Williams paint that has a quick set up time and allows us to spray the second coat within a short time frame. On two occasions the Sherwin Williams Representative came to the site to verify with the homeowner that there was the contracted two coats, the fact that we even exceeded the mil count (number of coats) of paint on the entire exterior. As for the windows, they were a separate optional project and price that was not accepted as part of the original contract. We were only contracted to paint the trim around the windows, therefore, confusion was created by the homeowners referring to the trim as "the windows" to the painters who new they were not suppose to paint any windows. Also, as per contract we only remove and replace loose, brittle and peeling caulk, fill in any caulked areas that are cracked to the areas to be painted. We do not do any unnecessary caulking and unless the homeowner went into the painters vehicle, would not know what supplies and materials were on hand. With this painting project, there was an issue of a missed spot and paint that came up when the tape was removed, that is the reason we require a walk around with the homeowner to make sure everything is to their satisfaction and allow us to alleviate any touch up issues. Despite the fact that the house was painted per contract, professionally and exceptionally painted and proven by Sherwin Williams to have two coats, we then proceeded to apply a third coat to try and please a homeowner, who exaggerated issues, was overly critical of every process and no matter what, we would not have been able to please. The painting project with weather factored in, was complete within a weeks time. Phil and his crew were the painters for this project. "During the time of the estimate appointment, the Homeowner(s) and Sales Representative do a "walk through" of the areas to discuss what the Homeowner(s) would like estimated and what their expectations are. It was at that time the Rep. informed her that our crews do not do faux painting, but, we would be able to put her in touch with faux finishers we have used in the past so she would be able to receive a separate estimate. The Rep. also explained to the Homeowner the type of faux finish she wanted was quite expensive and very labor intensive to apply and remove should it be needed for resale purposes. With that being explained to the Homeowner, the detailed contract, which was reviewed by her and the Rep. and left with the Homeowner(s) at the time of the appointment, did not include an estimate for faux painting. Prior to starting any project, the Rep and the crew Foreman discuss the details and expectations of the project. It was at that time the Rep. informed the crew that the Homeowner(s) were considering a faux finish and would be getting a seperate estimate. Throughout the time of production the Rep. was in contact with the client who stated that she did get a price for the faux finished and that it was well beyond the budget. CertaPro Painters therefore completed all repairs, prep and painting per signed contract agreement."
"On 3/18/11 CertaPro Painters were contracted to perform basic interior painting: Walls, Ceilings and Trim. The Job was completed an on 4/1/11 our Customer Comment Card was filled out by member with a Rating of all 5's and stated "The painter was very professional, timely, entertaining and a fantastic painter!" During our follow up on production the owner Rich Toriello requested that we come back for touch ups even though she was satisfied. Many months later she called Corporate with dissatisfaction and without giving us the courtesy or opportunity to address her issue. We were then notified by Corporate and determined to keep a satisfied customer we did work over and above our contract. Upon completing the touch ups the customer called again at a much later date to state our painter dripped paint on the hardwood and supposedly in an attempt to clean up the marred the floor surface. To further maintain customer satisfaction and our reputation, we agreed to refinish the questionable area at our $462.00 cost to Norburt Harwood Flooring. The member did not pay for this service as indicated in the report. Mid September the customer then called us with a "punch list". At the advisement of our attorney, we put together a formal list and the owner himself went back to perform additional work that was beyond our agreement. On 10/29/11 the homeowner signed off that all redo's were complete and to her satisfaction. CertaPro worked at the behest of the customer to retouch all work and re-cut all lines. Despite the false accusations of the homeowner, at no time did CertaPro ever "mix their own paint", purchase or use products and supplies from anywhere other than Sherwin Williams, with receipts on file to support those purchases. We use top quality brushes and paint on every job."
