"This order was placed, final measurements taken and then put in production the first week of September 2015. Products, Fabrics, Hardware, Manufacturing Labor and other items pertinent to this order were purchased with the $9000.00 down payment. Part of the order consisted of Plantation Shutters. These shutter normally take 6 to 8 weeks to arrive for installation. That is clearly specified on the order. The shutters have now arrived. Also, DraperyKing has installed completed Draperies in the Family Room, Breakfast Area and Master Bedroom. There is about 10% of work remaining. On October 10th the customer contacted his credit card company reporting an Unauthorized Charge of $9000.00 to DraperyKing. The $9000.00 was removed from the company account and DraperyKing filed “The Dispute Resolution” documentation with the credit card company. The credit card company evaluates the case. This can take up to 75 days. This action is very harmful to operation of DraperyKing and also our clients whose orders are being held up in production because of this. We try to avoid misunderstandings and establish expectations through our WARRANTY AND GENERAL CONDITIONS All clients receive this document and agree to the terms by providing the down payment for their order. Below are two violations of the Agreement between DraperyKing and this customer; 4. Item #4 Estimated Delivery Dates. The buyer will be informed or normal delivery date for the 5. manufacturing process. The seller has no control over issues with the manufacture or 6. shipment of product. Estimated Delivery Dates are not guaranteed by the seller. 7. DELAYS CAUSED BY THE MANUFACTURING PROCESS ARE NOT GROUNDS 8. FOR ORDER CANCELLATION. Item #9 Regardless of which payment option is chosen by Buyer, all such options shall be bound by the following provisions, because the delivery is based on many variables: both parties acknowledge and agree that there may be delays not contemplated and which may cause one or more items in the order not to be delivered on time. All parties agree that the non-delivery of one or more items when the balance of the items are delivered is not a basis for cancellation of this Contract; further, the parties agree that the Buyer need only pay for those items delivered and can pay for the other late items when they are delivered. The customer must contact his credit card company and correct the false claim that the charges to DraperyKing on August 29 2015 were unauthorized. The customer himself signed the card reader authorizing the transaction on August 29 2015. Once the funds have been returned, DraperyKing can complete the remaining 10% of the order."
