"It is a repair, you would not spend the money required for the entire chimney to be fixed. The entire flashing area was covered in tar and we removed the tar and did new counter flashing in copper. We responded to your concerns and came back out and did not see any moisture in the area of the repair we did. We came back out a 2nd time and saw no moisture in the area of the repair we did. At that time we also put new cement on top of the chimney and repaired a separate leak in another valley at no charge which was about and additional $500 in work. We said we would come back again and look for a third time but we can not be responsible for the fact that it does need more work than you are willing to do. The chimney needs new masonry work done by a mason the cement in the entire chimney needs to be repaired and that is not work we do. The repairs we did were necessary and stopped the water coming in in the areas we repaired."
"We have been in contact with you since you requested this work to be done. The original 2100 dollar work was not just for the chimney that was for other leaks you had which we fixed. The chimney is a new leak. We came back out and gave you an estimate which you agreed to. We have you on the board and you are still inline to have it repaired. When we gave you the new estimate we explained we are about 2 months out on repairs. You agreed to this. I have responded to every email you have sent us and still have you on the repair list. I do not understand why you would give us a F for work we have not completed yet and you were told you would have to wait from the beginning. I am assuming you would not like the work performed now and will be taking you of the repair list."

"Dear Mrs. [Member Name Removed]: Hastings Roofing, Inc. has been in business since 1948. With that said, we have always performed to our highest performance to give our customers the best job they require and need on their roofs. In November of 2016, you accepted the job for the new front porch roof with new plywood and lifetime shingles (which was stated in our proposal) including the chimney repairs which we did on a timely manner. You gave us the 50% deposit required which we appreciated and completed the job on November 18, 2016. On that same day you emailed us with concerns about the chimney area. Upon discussing with one of the men on the job, he stated he was able to locate the actual leak around the chimney which was around the metal duct. He re-caulked and sealed around the metal flange of the metal chimney flue where the [Member Information Removed] was entering causing the leak. There was no disturbance to the shingles or replacement necessary because the leak was found and repaired. In the proposal it did state that we would remove the shingles around the chimney, install new ice and [Member Information Removed] shield and new shingles to match this area as close as possible. But this was not done because our worker was able to locate the leak and fix it appropriately. We understand that you were upset that we did not perform this portion of the work according to the proposal. We offered to deduct the chimney repair work at an original cost of $550.00 against the price. We reached out to you many times but you failed to respond. The front porch was completed with new plywood, ice and [Member Information Removed], 30lb. roofing felt and new Lifetime shingles as stated in the contract along with repairing the chimney, and we never heard from you saying you were continuing to have any leaks. In February of this year, we did send you a breakdown of the work as you had requested. Again we did not get any response from you. We then sent you a letter in the mail on March 9, 2017, stating again we would like to resolve this matter in dispute and since work was completed back in November we are still owed the balance due. On March 16, 2017, we filed with the Westchester County Clerk's Office a Notice of Mechanic's Lien due to the lack of communication from you. On that form, we did not inflate any prices whatsoever. We listed the actual amount that was agreed upon by you of $5,500.00 per our proposal and the actual balance due of $2,750.00. Again, we made many attempts to try and work with you to fix the matter of the chimney portion of the work, even willing to deduct $550.00 from the job. Regardless of the chimney work, we still completed the front porch work and are due the balance. Every time we tried to reach out to you, you chose to ignore us via our emails, phone calls and snail mail. Because of your lack of response, we could only conclude that you had no intention in paying us for the work we performed in November 2016. Therefore, that is why we had to file a lien with the County for payment due."
