<p>I signed a contract with Jerry of JC3 to remove my existing fence and to install a new 6 foot tall western red cedar privacy fence. Jerry’s communication skills were less than stellar, but we met a few times to discuss the project in detail. He seemed like he was very detail orientated, conscientious about his work, and he seemed to want to do a good job. He provided an estimate and I put together a contract, with a price not to exceed, detailing everything that we discussed. He looked at it and verbally gave me the okay. Jerry told me that it would take about 3 days to do the work.</p> <p> On Thursday, June 2 he signed the contract and collected his 50% deposit and he and his buddy began work on Monday, June 6 (despite us agreeing that this would be done on the weekend so I could be home without missing work). They also worked on my project on Tuesday, June 7 and Wednesday, June 8. On that evening, he sent me an email saying he needed an additional $1000. That’s over 30% more than the original not to exceed price! I didn’t tell him that I wouldn’t pay him more, but I needed more information about why. Unfortunately, he wasn’t sure where he made his mistake in his pricing.</p> <p> He and his buddy showed up for only a couple of hours on Thursday, June 9. On Friday, June 10 they were back working, and before I caught it he had installed most of the fence with the wrong materials! The contract specifically stated 3/4-inch thick pickets, however, he installed 1/2-inch thick pickets. I brought it to his attention via email and text message and I was under the impression that it would be corrected. The entire fence was to be very stout (6x6 posts and 2x6 caps and rails) and he tries to get away with this paper thin picket. It looked very nice initially, but it’s not going to hold up. They’re already starting to bow in and out.</p> <p> In short, we had run into a few other issues along the way too. He built us the wrong gate. A picture was even provided in the contract so there would be no mistakes. He placed a few fence posts in wrong locations, but they were corrected. I still have six posts out of approximately 17, though, that were not buried to frost depth (32” below grade). They might be 20” or 24” deep if I’m lucky. This may have been a miscommunication on my part, but we had talked two or three times about how to address the soil that was being held back by the old fence where we had a small grade change. He led me to believe that it would be taken care of. I had even provided some sketches to him showing exactly what I wanted done. When he didn’t do it, he says, “Oh, you wanted me to do that work?” I told him to just forget about it and I would just do it, and I did. Another big thing is that I knew he didn’t have money in his job to haul away extra soil from the post holes and grade change so I offered to pay him to do it. Instead he piles it up behind my garage and on another neighbor’s property! When I asked him about it, he complained about having to handle it too many times and he couldn’t see what the big deal was!</p> <p> He returned Sunday, June 12 for only a couple of hours. He removed most of the improperly placed soil and instead of hauling it away he piles it up partially in the city right of way and partially on another neighbor’s property! I would estimate that it was about a cubic yard of material. He never returned after Sunday and refused to take my calls or respond to texts or emails.</p> <p> I sent him a letter calling out the issues for material breach of contract and I gave him a date by which to contact me to discuss remedying the issues and completing his work. The date has come and gone. I will have to estimate the work that is properly completed, settle the money, remove improper materials, and complete the fence on my own.</p> <p> Don’t hire this guy!</p> <p><br></p>
