Overall the installation of the egress window was not successful. From the start of the project the two individuals that showed up were late, they said that they were running behind because they were both out of gas and needed to stop by Home Depot to pick up some 2x4s. Once they arrived they were polite and friendly and seemed to be helpful and knowledgeable. Once they started the actual project they were missing tools that were needed so they borrowed some of my tools, which included a hammer, mallet, drill, circular saw, 5 gallon bucket, trash bag and step ladder. They also had to run to the store 2 times to get additional tools. When Andrew was cutting the wall the saw slipped from his grasp and cut into the siding two times. When I asked him what we would do about this he stated that there was nothing that I could do to prevent that but you can use color match caulk and that will be fine. After clearing all of the bricks out of the hole the began to measure, cut and assemble the window frame. They did this on the uneven ground. Once the frame was created they screwed the window onto the frame prior to putting the frame into place in the cut wall. Andrew was inside operating the ramset and James was in the hole attempting to align the window and frame with the foundation. Because of the widow being in the frame as they tried to attach the frame to the block foundation, the communication between the two seemed to be strained and they could not hear each other well as they kept repeating themselves to each other. Once they had the frame "close enough" Andrew fired the ramset and the first nail was attached. He then fired 3 additional nails setting the frame into place but the frame was crooked. They began to spray foam insulation on the inside and mortar on the outside further locking the crooked frame into place. When I was in the basement with Andrew checking the work, I noticed light coming in from the top right side of the window where the seal and window frame meet. I asked him about it and he said that there is light coming in all around the seal and to not worry. What I was pointing out to him was different then what light was shining in from the other areas where the seal meets the window. He began to look harder and stated that the window was faulty and would need to be replaced. At that time he said to me that they could just finish up with all of the other things and I could just attach the window later myself. I told him that I was not comfortable with that and I would just go to Menards and buy a new window, which I did. After I returned with the new window they installed it again. I then check the window and the same issue was still there. I suggested that it could be off because the frame apereas to be crooked. Andrew said that it didn't matter because the window frame does not have to be perfect in order for the window to be good. I told him that I wanted it to be fixed so there was no light coming through. Andrew and James started talking about possible solutions, none of which included fixing the frame. They ultimately decided to shim the window because shimming the frame was no longer an option. The window itself is not supposed to be shimmed, which I told them, but he insisted that it wouldn't make that much of a difference so I just accepted his expert opinion and walked away. Once they got the window to where they thought that it would pass my inspection they began to attach the window well. As they were packing up and leaving I went to the basement where Andrew was and began to look at the window and noticed that there was no longer any light coming through the spot where it was before and I asked him how did he fix it. He stated that the shims helped. I asked him if I have any issues with the window what should I do, he said just give me a call and we will take care of it. He then finished packing up and left. After they were gone we began to look closer at their work and noticed other issues with the window, including an air leak in the same corner that we could see the light coming through. Also, there were no screws in the bottom screw flange, instead they put one screw in the middle of the window sill voiding the warranty of the window. I called Andrew and he did not answer so I left him a voicemail asking him to call me back about the window issues. James instead calls me and asked for the remainder of the payment. I told him that we would be more than happy to pay the money once the window was fixed. He said that we needed to pay the remaining $600 plus an additional $900 to come back and fix the window. I told him that the window was not installed correctly and that they needed to fix it prior to us paying. He said that the contract does not say that the window needs to be installed "correctly" it just needs to be installed. I told him again that I am not going to pay for an improperly installed window he stated that he did not agree to meticulously install the window to make sure that it was done correctly. I told him again that we would be more than willing to pay the money once the window was fixed but he said that they are not fixing anything and demanded the money and threatened to put a lien on the house if we did not pay. After some additional threating text messages, we told him that any further communication would come from our lawyer.
