On January 21, 2023, we contacted Matthew Sullivan of Matt’s Paving regarding the installation of a parking area using crushed asphalt. The agreement was to grade and level the area, remove a stump, install the asphalt millings, and compact the area. The agreed upon amount was for $9,777. It took us a while to gather the funds. We contacted Matthew Sullivan on November 21, 2023 and put a deposit down of $5,000 to start the project on November 27, 2023. We spoke to him on December 2, 2023 and then again on December 5, 2023 to come and mark the property. Matthew Sullivan agreed to meet on December 7, 2023 at 4 pm. Matthew Sullivan(Matt) called and changed the appointment to December 9, 2023. At that time, he came and marked the property with spray paint. We reached out to him on December 14, 2023 to get an update. He called and said to send him pictures of the stump that was to be removed. That task was completed the following day. Another clearer picture was sent on December 17, 2023 and Matt said it was a good picture. Considering it was holiday time, we waited until December 27, 2023 to reach out via text. Matt did not respond. We called him on December 29, 2023 to get an update and left a message. Matt did not respond. We waited a few days and texted him on January 3, 2024. Matt responded on January 4, 2024 asking for us to call him. We had a conversation. Matt reached out again on February 6, 2024 and asked for us to call, which we did. We had a discussion concerning the stump grinding and the asphalt mills that were to be delivered. The stump was ground up by February 7, 2024. He texted that 2 loads of asphalt millings were being delivered to the property. He also mentioned that his son was to have heart surgery soon and requested that we pray for his son. The delivery of the millings was done on February 15, 2024. The same day, an attempt to level the property was made, but it was so wet that the scraper was getting stuck in the mud. So, Matt said that the ground would have to dry. Around that time, Matt requested that we provide $3,500 more because when he gave the original quote, prices for millings were lower. We agreed and provided the money on February 20, 2024. Matt came to the property on February 28, 2024 with one of his son’s to discuss marking the property. He talked about getting lime to dry out the property. We did not hear from Matt after that. We reached out to him again on March 30, 2024 (figuring that he did not contact us due to his son’s surgery). We asked if he ordered surveyors because some men came and put stakes on our property. Matt indicated that he did not order the survey. That same day we reached out and we had a discussion about Matt’s comments on “making a profit.” Matt indicated that because prices have escalated so much, that he would not be making a profit. We asked him how much more he needed. We wanted to be fair to him. We agreed to provide Matt with $1,400 more dollars. We sent Matt a picture of a piece of paper outlining the original price and the extra money we gave him and how much was left to pay him. We paid him a total of $9,900 and that left a balance of $2,277. Matt agreed. He picked up the $1,400 in two parts. $750 on April 1, 2024 and $650 on April 2, 2024. This would include the price of the lime. When Matt came to pick up the money,wearing a mask, we walked the property and part of the discussion was him requesting that we mow the grass and weeds and level the deep ruts that the machine made in the dirt. He said he would be over on April 3, 2024 at 5:30 pm to mark the property again. We waited an hour and he did not show. When we texted him, he said that he was still across town and that he could make it the next day. So we agreed to the same time on April 4, 2024. We waited for him and he did not show up. We texted him at 5:41 pm and called him 3 times and Matt responded at 7:39 pm saying that he was sick and did not want to get anyone else sick. We texted back that we waited an hour outside for him and provided him with the extra $1400 he requested and picked up, so why was it taking him so long to start? We got no response from Matt. On April 6, 2024, we sent Matt pictures of the property mowed and filled in. He did not respond. We called Matt on April 13, 2024, left a message and he did not respond. We texted him on May 25, 2024 and Matt did not respond. My mom, Leonida Rios-Perez, called and he did not respond. My adult son, Victor Benitez, called and Matt did not respond.
