tatement of Dispute with Contractor Sunny Miguel This statement documents my experience and concerns regarding a construction project with Sunny Miguel, from our initial contact on August 4, 2025, to the final payment on August 24, 2025. 1. Initial Agreement and Price Change On Monday, August 4, 2025, I met with Sunny Miguel to discuss work on my property. During this meeting, Mr. Miguel verbally quoted a price of $6,500, with a potential increase to $8,000 if a new brick wall was needed. I requested a contract to formalize this agreement. The contract he sent over, however, listed the price as $8,500 for the initial work, increasing to $10,000 if a full wall rebuild was necessary. When I called him to question the price change, he stated he had misquoted the price initially and that the contract price was correct, adding that I would need to pay this amount for the project to be done properly. He verbally offered to include additional services, such as power washing, at no cost to compensate for the misquote. 2. Breach of Initial Agreements I verbally agreed to begin the project on a Saturday, as I work during the week and wanted to be present. Mr. Miguel agreed to this. He later texted me, stating his crew would begin on Thursday, a time I had not agreed to. When I called him about this, he insisted they needed to start immediately and that I did not need to be on-site, assuring me he would be there to supervise. I paid him a $3,000 down payment, which he stated was for materials and supplies. 3. Unauthorized Work and False Information When I arrived home on Thursday, I discovered the workers had removed only the top portion of the siding and had applied stucco and cement to the bottom half of the house, a task I had not requested or authorized. Mr. Miguel was not on-site; his brother, who was present, stated the stucco "looked better that way." The top portion of the house was a source of continued misrepresentation. Initial Claim: Mr. Miguel's brother stated it was brick or stone and they would try to repair it. Subsequent Claim: Mr. Miguel later called me and said it was metal and they would simply cover it. He claimed there was no brick wall behind the metal, but only a large opening. Verification: I asked for a photo or video to verify this claim. On Saturday, August 16, 2025, his workers removed the metal to reveal that there was, in fact, a brick wall behind it. Mr. Miguel, upon arriving at my property, stated this was "making more work for him." 4. Sloppy Workmanship and Property Damage Friday, August 15, 2025: I returned home to find boards attached over the existing, rotting wood on the top portion of the building. This was done without verifying what was behind the metal. I had the boards removed and expressed my concerns about the "sloppy and rushed" work. Power Washing: Despite my explicit instructions not to use chemicals, Mr. Miguel’s brother admitted they had used acid to power wash the bricks. He stated he would return the next day with a different acid solution, which I told him not to do. Property Damage: My bush was cut down, and Mr. Miguel initially denied it, claiming it was already in that condition. He only acknowledged the damage after I showed him the other half of the bush under the rubble, at which point he used profanity. Left Materials on Roof: Mr. Miguel’s workers left building materials and other debris on my roof after working on the siding, creating a safety hazard and an unprofessional appearance. 5. Continued Escalation and Failure to Perform Throughout this process, Mr. Miguel repeatedly changed the quoted price for the project, escalating from $6,500 to $8,500, then to a range of $9,000 to $18,000, and finally to a new price of $15,500 to finish a modified project (after he "knocked $500 off for the bush"). Furthermore, Mr. Miguel failed to complete basic tasks and maintain professionalism. Debris Cleanup: The site was never properly cleaned. He promised a dumpster that never arrived. Debris was left on my property, my neighbor's porch, and the side lot. Despite repeated promises of cleanup on Friday, Saturday, and Sunday, it was never completed. I had to pay someone else to clean the area, which was the direct cause of me receiving a complaint from my neighbor. Intimidation: On August 24, 2025, after I notified him that I was terminating the contract, he called me, stated I was "crazy" for making him "lose money," and threatened to put a lien on my house. He stated, "he could and would do that" and that it would be "best to give him money before he takes my house away." Under duress and out of fear, I paid him an additional $2,900. Summary In total, I paid Sunny Miguel $5,900 for a project that was incomplete, unauthorized, and performed with a lack of professionalism. The work was performed in a way that contradicted our verbal agreements, the scope of work was repeatedly changed without my consent, my property was damaged, and I was subjected to intimidation and threats.
