"The customer contracted Oakwood to correct the problem of water running into the garage from the driveway due to improper installation of the existing drainage system and to complete the landscaping initially started but not completed by a previous contractor. The drains installed by a previous contractor were flat bottom pool drains and did not allow for proper drainage. It is my understanding that Oakwood is the third contractor hired for this job. I had several phone conversations regarding the drains with the [Member name removed]’s. I explained that the drains had to be order based on the width of the driveway and depth of the concrete. The driveway was measured on each side at 4 to 5 inches in thickness and the drains were orders. Oakwood had made a 30” cut by 40’ in the driveway in preparation for the new drain system. The concrete was not removed per the request of Mr [Member name removed] because they wanted to still have access to the garage while the custom trench drains were ordered, with delivery scheduled for early June (3 weeks out). After Oakwood’s concrete finisher ordered the drains, our Foreman was approached by [Company employee name removed] of [Company name removed], one of the previous concrete contractors, and we were informed that the concrete was 12” thick at the drain; therefore, the drains that were ordered were incorrect and could not be used. [Company employee name removed] was unaware that another contractor had been hired. He also stated that the [Member name removed]’s had not paid him for work he had completed. We understood that the [Member name removed]’s had withheld payment due to the drainage problem created from the work [Company name removed] had done. Oakwood’s concrete finisher did core drilling and found that the drains would not work. Oakwood’s concrete finisher has spent $3,396.78 on drains, less a payment of $2,400.00 from the [Member name removed]’s, leaving a balance of $996.78. The drains were returned to the supplier and new drains were being made when Mrs. [Member name removed] informed Oakwood that the previous contractor had agreed to repair the drainage problem created from his concrete installation and demanded her $2,400.00 deposit be returned. Therefore, the new drains were cancelled. After the original drains were returned the concrete finisher was issued a 60% credit, $2,037, plus shipping and handling charges of $380.00. The total cost of the materials after discounted return and shipping and handling was $1,739.78. The [Member name removed]’s deposit was $2,400.00 on the drains. The [Member name removed]’s refund should be $660.22. Oakwood will settle with the concrete finisher for the cost of his time in ordering and returning the materials and time on the job. Oakwood began communicating via text to have documentation of our conversations. Unfortunately, it seems that the [Member name removed]’s have not been satisfied with Oakwood or any of their previous contractors; however, Oakwood Construction was the only contactor with an Angie’s List profile."
