TUESDAY NOV 14, 2023 Johnny Garza ( Pro-screte Concrete) called me on Tuesday 11/14/23 in regards to a driveway cement job I posted on Angi's list. Johnny Garza got my cell number from Angi's List. I agreed to meet Johnny Garza at the jobsite on Friday 11/17/23 THURSDAY NOV 16, 2023 Johnny Garza texts me to make sure I'm coming on Friday. FRIDAY NOV 17, 2023 I meet Johnny Garza at the house to scope the new driveway project. Johnny Garza quotes me a price of $9,620. Johnny Garza promises to send over a written bid that day. The same day I draw a detailed sketch of the new drive way with dimensions and I text the drawing to Johnny Garza. In my email,I receive the Pro-screte form letter with a bid amount of $9,620. I tell Johnny the bid looks good and that we'll get together the following week to discuss a start date. MONDAY NOV 20 ,2023 I text Johnny Garza and tell him I can meet him at the house ( jobsite) on Wednesday NOV 22, 2023 to provide a 1/2 full payment. Johnny Garza replies in a text that he'll meet us on Wednesday. WEDNESDAY NOV 22, 2023 My wife and I meet Johnny at the house and give him a check for $4,810. The check is written out to Pro-screte. Johnny tells us that he can start the job on Monday NOV 27, 2023. Johnny gets in his truck and drives away. A few minutes later Johnny Garza returns and says he needs the check written out to JOHNNY GARZA... not Pro-screte. My wife writes a new check. MONDAY NOV 27, 2023 Johnny Garza sends me a text Monday morning at 7:05am informing me that he " has the machine scheduled for tomorrow." TUESDAY NOV 28, 2023 Johnny Garza sends me a text at 7:10am that he " was misinformed about the machine." He's " picking up the machine after 1pm." and that with the early sunset tomorrow would be best to start work. WEDNESDAY NOV 29, 2023 I'm at the jobsite. Johnny Garza has a skid steer and 1 helper standing around with a shovel. Johnny Garza excavates the driveway and piles all the dirt and broken cement in the middle of the front yard. Johnny Garza says he'll haul off the debris later. Johnny Garza and helper work 3 hours. Johnny Garza puts the skid steer back on the trailer and leaves to return the machine. No more work that day. It's 11:00am. Thursday NOV 30, 2023 It rains. No work. FRIDAY DEC 1, 2023. I'm at the jobsite. Johnny Garza and same 1 helper install 2x4 forms on each side of the driveway. They work 3 hours and leave. SATURDAY DEC 2, 2023 I receive a text from Johnny Garza at 7:44am requesting that I bring a check today for the final payment of $4810. Johnny Garza says I need " the other half so I can go pay concrete today to get poured this week." At the job site- I hand Johnny Garza the final check and I tell him that I'm not happy paying him the full amount with so much work left to be completed. Johnny Garza promises me the job will be finished early next week. Johnny Garza and 1 helper work 3 hours and leave. MONDAY DEC 4, 2023 I texted Johnny Garza at 10:48am and ask for a status report. Johnny Garza replies at 11:19am that he went to the cement vendor on Saturday but they were closed. He called them this morning and is waiting on a call back. At 11:54am I reply in a text for HIM to call the vendor back or to call another vendor because I need this project completed ASAP. At 12:02pm Johnny Garza texts that he did that already. Saying "Just making sure they fit the budget" he's on. TUESDAY Dec 5 2023 I text Johnny Garza at 11:05am and ask him to call me with an update. No reply to my text. I call Johnny Garza and leave a message for him to call me. No reply to my phone message. WEDNESDAY DEC 6, 2023 At 9:54am I text Johnny Garza and ask for a status on the drive way project. No Reply. I call Johnny Garza and leave a voice message to call me. No reply. At 3:50pm Johnny Garza replies that his Uncle died over the weekend and he's been busy with that. Johnny Garza texts that he set the concrete for next week Wednesday at 7am. He also said " I'll start to get the dirt out on Tuesday". At 3:54pm I replied: Cement next Wednesday 12/13/23 .... fantastic. You're removing the dirt on Tuesday 12/12/23? At 3:55pm Johnny Garza replies: Yes sir I'll start the clean up. MONDAY DEC 11, 2023 I text Johnny Garza at 8:27am: I want to make sure you're still on schedule for the dirt removal tomorrow and the cement pour Wednesday morning. Let me know. No reply from Johnny Garza. At 4:55pm I send Johnny Garza another text: See you tomorrow. No reply from Johnny Garza. TUESDAY DEC 12, 2023 ( DEBRIS HAUL DAY) I'm at the job site. At 9:17am I text Johnny Garza: Johnny- I'm here . When are you arriving? No reply from Johnny Garza. No dirt is removed. No Johnny Garza. At 2:37pm I sent Johnny Garza a text: Johnny- per your text from 12/06/23 to remove the debris today 12/12/23 nothing has been removed. In addition- the rebar has not been properly lashed. The support stakes for the forms are too far apart and will not properly support the cement or create the dimensions we discussed. Tomorrow is day 21 of this project. The unnecessary delays on your part have been continuous. The pour date you set for tomorrow cannot occur until you repair the rebar, the cement forms and remove the debris. Please let me know what time you will be at the job site tomorrow to correct these items. No reply from Johnny Garza. WEDNESDAY DEC 13, 2023 ( POUR DAY) I arrive at the job site at 6:30am in anticipation of the promised cement pour at 7am and repairs to the forms, rebar and debris removal. No Johnny Garza. No texts... no nothing. At 2:22pm I text Johnny Garza: As required by law I am requesting a refund of $8,620. Your 3 hours work excavating and the rebar you left at the job site have a value of $1000. You have 10 days from today to refund the requested money. My suit filed in court will request $8,620 plus court and attorney fees.

Johnny Garza texted me saying he was with Proscrete concrete and wanted to quote my project. He came and gave me an estimate of $2550. He initially asked for all the money up front but I refused as that is not right. I gave him half the total for work to get started. He and his crew removed the old concrete portion of the driveway then poured new concrete. I then noticed they did not smooth the edges of the concrete, there were many surface and edge cracks and the expansion gap had been done when dry instead of wet. Overall very bad quality work, which I verified with other contractors who came by to look at it. I asked for his insurance and he did not give me it but instead said he would redo it at no cost. We decided to wait until construction in my backyard was done so heavy machines wouldn't go over the new redone concrete and he said he'd stay in touch over the next few weeks. He never texted or called again. I've been trying to call and text him using the number he used to text me from (210-993-9235) but it goes straight to voicemail which is full and he has never texted back. I tried emailing them at the email listed for them on Angi but have gotten no response.
