Pre 3/20/2015 (putting the story into context): <br /> I discovered a hole forming in my backyard over my septic tank in early March, 2015. After excavating the top of the septic tank and the outlet line from the septic tank to the distribution box, I discovered that my tank had been damage at the point the outlet line leaves the septic tank and that my septic tank outlet tee had been removed. These two issues allowed sand and the scum layer of the septic tank content to flow into my distribution box and drain field (a.k.a., leach field). The end result of these problems was that my drain field pipes were 100% clogged. <br /> I received quotes for a new drain field from 3 septic companies but did not feel comfortable with the company representatives. I also called a fourth company, Southern Water and Soil, Inc. ("SWS"), after spending some time at their website. I did not make an appointment, however, because I was told there was a six week waiting period because of the amount of business the company had. <br /> Because I could not find a company that I was comfortable with to do the job, I took on the project myself. I printed out the Florida code, researched the materials, diagrammed the system, and assessed my septic tank damage. This took some time. After reaching a point were I felt my plan was close enough to order the materials and start the work, I decided to find a septic company that would be willing to provide me with two hours of consulting and I would pay them $200 per hour (a bargain if you consider all that could go wrong installing a septic system yourself). <br /> 3/20/2015 through 5/4/2015: <br /> I recalled being very impressed with SWS's website (by the way, the website stated that Greg Mayfield formerly worked at the Hillsborough County Department of Health inspecting septic systems for compliance with Florida code), so on 3/20/2015 I sent an email to SWS, offering to pay $200 per hour (2 hour minimum) to assess my property, plans and the materials I had selected. SWS accepted my offer and Mr. Mayfield came by my property later that day. After assessing the current state of my septic system, Mr. Mayfield informed me that my existing septic tank should be replaced but that it could be repaired enough to pass an inspection. If I chose to take Mr. Mayfield's advice and replace the septic tank, I would not be able to complete the project myself. Mr. Mayfield then provided me with a ballpark quote for his company to complete the entire project, with the stipulation that I had to wait until April 29, 2015 before he could begin the project. <br /> At that point, my drain field was completely non-operational, which meant I was pumping out my septic tank every six days at $225 per pump. That meant that I would have to pay approximate $1,300 in septic tank pumps just to do business with SWS. I was very impressed with Mr. Mayfield and drew comfort from knowing that he previously worked as a code enforcer. So on 3/20/2015 I decided to contract with SWS to install a new septic tank and drain field and gave Mr. Mayfield a check for $1,000 check, as a deposit, to secure a spot on SWS's calendar. On the same day Mr. Mayfield provided me with a option sheet that contained three different septic system configurations for my property and the associated price for each system. <br /> On 3/26/15, I signed a contract with SWS for a drip irrigation septic system for $15,200. However, after doing additional research and discussing drip irrigation systems with the Department of Health, on 4/17/2015 I contacted SWS and asked if I could change my selection to the "all-in-one" 1,500 gallon septic tank with an infiltrator chamber leach field for $9,900. SWS approved this change and it was memorialized with a new contract. <br /> On Monday, May 4, 2015, Greg Mayfield and crew installed the new infiltrator septic tank on my property. <br /> The Problem: <br /> The septic tank was installed in the wrong location, which prevents me from completing two other projects. The importance of the septic tank location was communicated multiple times: <br /> - 3/20/2015 - Mr. Mayfield and I stood on the agreed upon location of the new septic tank and I explained (in detail) how I planned on expanding the current footprint of my carport / laundry room south and that I planned on enclosing the carport and building a workshop inside the garage. This required the septic tank to be installed running north / south. Mr. Mayfield said that would not be a problem. <br /> - 3/26/2015 - At my request, Mr. Mayfield provided me with a sketch (on a copy of a professional survey of my property) the exact location of the septic tank. Mr. Mayfield sketched it running north / south, as I requested, in the location I requested. In other words, Mr. Mayfield drew the sketch exactly where I wanted the septic tank to be. <br /> - 3/27/2015 - In an email I sent to SWS, I included a sketch, prepared by me, showing how I wanted the sewage line to be installed from the location of the existing septic tank to the location of the new septic tank. The sketch, which was also prepared on a copy of a professional survey of my land, showed the new septic tank installed in a north / south configuration in the exact location I wanted it in and we agreed to. Further, the email reiterated the importance of location due to my planned project to expand the carport to accommodate a workshop. <br /> - 5/4/2015 - I sent an email to SWS before construction started to ask several questions related to the installation and as an additional reminder about the septic tank location and the need for the adjacent land for my other project. <br /> On 5/4/2015 I received an email from Mr. Mayfield stating that the septic tank had to be installed on the south border of my property (running east / west instead of north / south) because it would not fit in the location we previously discussed. <br /> The location that SWS installed the tank in, which is where it sits today, prevents me from proceeding with both my short term and long term projects. <br /> The Facts: <br /> (1) Mr. Mayfield and I discussed, put in writing and each drew a sketch (on a professional survey of my property) the required location of the new septic tank. There were at least 4 instances of communication. (EDITED ON 9/14/2015 - During Mr. Mayfield's 3/20/15 consultation, Mr. Mayfield and I had a very detailed discussion covering all aspects of my septic drain field project. After Mr. Mayfield advised that my existing septic tank was a hazard, I decided replace it. Florida code prevented using the existing tank location for the new septic tank, so Mr. Mayfield and I spent the remainder of the consultation discussing system configuration options. They were: (1) gravity system using same leach field location and new tank location ($9,900), (2) pump vault unit with new leach field and septic tank locations ($9,900) and (3) drip irrigation system with new tank and drip line locations ($15,200). It was not until 3/26/2015 (six days after our meeting), that I seriously considered the drip irrigation system. To ensure I understood the system footprint on my property, I asked Mr. Mayfield (via email) to draw a sketch of the drip irrigation system configuration on a survey of my property. Mr. Mayfield provided me with the requested sketch of the drip irrigation system on 3/26/15 showing he septic tank in the location as discussed on 3/20/15. Mr. Mayfield claims he never received my 3/27/15 email with my sketch of the "pump vault unit" system configuration, including septic tank location. My gmail account shows the 3/27/15 email having been sent.) <br /> (2) The information Mr. Mayfield submitted with the application for permit with the Hillsborough County Department of Health included an additional sketch, signed by Greg Mayfield and dated 4/24/2015 showing the new septic tank installed in an east / west configur
