I hired Taylor’s Tree Service to remove a large tree from a rental property that I own. The agreement included the grinding of the stump, as well as the removal of all but 1/2 cord of wood, which my tenant wanted to use for firewood. I was out of town on business when Rob, the owner, and his crew came out a couple days later to remove the tree. He called me on the morning of the tree removal to increase his bid by $500.00, indicating that that the tree was so rotted, he needed to rent specialized equipment, as it was unsafe for his crew to do the job using nothing but ropes. Since I know that unexpected circumstances can arise, I agreed to the added expense without hesitation. (I now wonder if he planned this all along.) I returned home shortly thereafter and met with Rob first thing in the morning to pay him in full for his services, even though the clean-up was pending; I have a busy schedule and I naively assumed that he would finish the job, per our agreement. Rob, took my money and ran; it has been 2 ½ months since he took down the tree, but he never returned to haul away the remaining wood/tree trunk sections. Instead of ½ cord of wood, he left behind approximately 5-6 cords of wood, most of which was way too large to easily handle (and certainly was too large for its intended purpose of using in a backyard firepit). In addition, he left several ENORMOUS cross sections of the tree trunk behind. (One section alone was roughly 3 feet tall and 4-5 feet in diameter.) I contacted Rob multiple times about hauling away the remainder of the wood. Initially, he indicated that he was attending to several emergencies following a series of storms, but he would finish the clean-up and haul away “soon.” I gave him a couple weeks before reaching out again, at which point he ghosted me. It wasn’t until I texted him stating that I would file a complaint with the Better Business Bureau and write negative reviews on consumer websites that he finally responded. He was LIVID and threatened to sue me for defamation if I did so. According to him, hauling away the remainder of the wood was not his problem because he “gave” the wood to somebody else. (Apparently, somebody Rob knows was interested in using the tree trunk sections to make furniture; however, that gentleman came out and, after inspecting the wood, he indicated that it wasn’t suitable for that purpose, so he did not haul it away.) In a text message to me, Rob stated, “I do not like the way you’ve been coming at me if you were being a little bit nicer then maybe I would be more interested in helping you.” He made it abundantly clear that I was never to contact him again. I knew Rob had no intention of honoring our contract, so I ultimately had to pay somebody else to finish the job.
