On March 11, Tony and I did a complete walk around my property to assess the water flow, tree layout, and land layout (hills on all 4 sides of house) and how to best address the front, side lawn issue as well as bury downspouts to divert water properly away from my house. At this time a soil sample was done to assess soil and grass issues. Tony wrote a simple, incomplete contract and this should have been the first clue to me that his company should not have been given the job.
DON?T ACCEPT HIS CONTRACTS THE WAY HE WRITES THEM! DO NOT BELIEVE HIS GUARANTEES!
On April 11, Tony?s crew placed soil/seed on the front lawn with a Curlex covering (supposedly to hold seed in place.) Numerous other lawn companies indicate that Curlex is only to be used on steep hills (to prevent runoff.) I don?t have a steep hill on the front or side lawn where the soil, seeding was done.
By May 24th, the front lawn had grown enough to have the grass mowed. However, by mid-June the front lawn had started to die off in places where the Curlex seemed to be strangling, smothering the grass. By mid-July, the lawn looked like it had a
disease with more than half of the lawn showing signs of browning from not taking proper root in the soil. Note: this browning was not due to a lack of watering, as Tony claimed, as it was watered and we also had a much wetter spring than in other years. Tony also claimed the Curlex would ?dissolve? over a short time. However, even after 10 months, the Curlex is still on the lawn and has to be cut away to even rake leaves.
In addition, to hiring this company for the lawn soil and seeding, etc., I also paid them to bury 3 downspouts to effectively carry,
move water away from the house. Tony?s crew buried only 2 downspouts and did so incorrectly. One of those downspouts was incorrectly directed to the right back corner of my house where the water pooled under the downspout which they weren?t paid
to bury. The other downspout was directed to my neighbor?s yard, patio area where it flooded his basement.
When I contacted Tony about these issues in the Spring 2014, he tried to extort more monies from me for the job he was already well paid. I gave him the Summer of 2014 to remedy the issues, and he failed to address, correct them. I contacted the BBB in the Fall 2014 to start a complaint against the company. While waiting for BBB to resolve the complaint, Tony told another lawn company to come to my home (whereby they trespassed on my property) to do a consult (at Tony?s instigation) as to what were the issues with my lawn. This ?consult? company wrote an e-mail to Tony saying I had grubs in the lawn!
However, I had already hired a reputable lawn company which had done a formal report of my soil, lawn and indicated there were NO SIGNS OF GRUBS ANYWHERE! Tony offered me $100 to not go to arbitration with BBB. I declined as I do not want another person to go through what I went through.
To add to this horrendous fiasco, when I went to BBB arbitration, I lost the case. Not because there wasn?t enough proof of failure to fulfill the guaranteed contract (only 2 downspouts were buried, and those 2 were buried incorrectly; the contract clearly states 3 downspouts will be buried AND guaranteed grass growth.)
I have been informed by the Maryland Home Improvement Commission (MHIC) that BBB hires arbitrators to hear BBB cases against businesses which pay to be listed in the BBB. BBB rates the companies and gets paid as long as those companies continue to pay and be listed with BBB. So the BBB complaint resolution process, to me, is a scam. I was told by the Greater Maryland BBB that the arbitrators hired by BBB were independent.
However, they may not be competent in simple things such as contracts, landscaping issues, mere concept of water runs downhill, etc. In addition, the BBB site now indicates that my complaint (all details deleted, hidden, removed) ?was resolved? when in fact it was NOT resolved. If you have a complaint against this company, go to the MHIC and file a complaint, NOT the
BBB.
