"Unfortunately, the homeowner's recounting of the events is both misleading and inaccurate. WarrenCo abided by the terms and scope of work as agreed upon in the contract. This situation is a perfect example of why contracts are utilized in the first place. The homeowner did not like the fact that WarrenCo, in accordance to the terms of the contract, expected payment upon the completion of his project. When payment was requested he refused to remit for the balance owed. After the homeowner's conversation with our Project Manager failed to amicably resolve the situation, Joshua Warren, the owner of WarrenCo contacted the homeowner regarding his concerns. When the homeowner continued to refuse to pay and the conversation entered a stalemate, the homeowner was informed that WarrenCo would take the necessary measures to protect its right to collect as allowed under statute. While unfortunate and a step that WarrenCo avoids if at all possible, this is sometimes a necessary part of doing business. Further, the homeowner's comments regarding his expectations and the use of industry-specific terms is incorrect. WarrenCo will backfill with the spoils left over from the job. However, WarrenCo specifically calls out in our contract that we do not backfill with pulverized topsoil, etc. but that this is an add-on option available. The homeowner did not elect this as part of his package. Furthermore, the comment regarding finish simply has nothing to do with backfill but rather the type of finish applied to his concrete which was, in this instance, a broom finish. While we regret his unhappiness, the homeowner has a beautiful project that WarrenCo is proud to have installed with the same workmanship and quality that our customers have come to know and expect."
"Unfortunately, the homeowner's recounting of the events is one-sided and lacking in both merit and facts. WarrenCo was hired by the homeowner to install an outdoor living space that included a concrete patio and a fireplace. When the homeowner expressed their unhappiness with the fireplace, WarrenCo offered to make cosmetic adjustments in accordance to the homeowner's desires. The homeowner continued to voice their displeasure so WarrenCo offered to provide a discount on the balance remaining or as a last resort to simply come out and remove the fireplace and refund the deposit that had been paid. The homeowner felt that WarrenCo should allow them to keep the fireplace and not owe any additional money for the work performed. With such an unreasonable offer and the unlikeliness of meeting the ever-changing expectations of the homeowner, arrangements were made to remove the fireplace and refund the deposit. The details that the homeowner failed to mention in their recounting of events, were that they made documented threats of violence against our crews, multiple profanity-laced phone calls, and even showed up at WarrenCo's office causing a scene that required the police to be called and the homeowner being trespassed from our property. While the end result of this experience was less than desirable, WarrenCo believes that we did our best to make the homeowner happy and provide the same level and quality of service that our thousands of satisfied customers have come to know [Member Information Removed] by."
"Unfortunately, Ms. [Member Name Removed] has completely misrepresented the majority of facts surrounding her project. While it is true that the install timeline admittedly took longer than expected by either party, this is a direct result of the record levels of precipitation for the months of June and July that was experienced throughout the entirety of Central Indiana. WarrenCo simply does not have any control over the weather and stayed in constant communication with Ms. [Member Name Removed] regarding the unforeseen delays. Upon completion of the project, Ms. [Member Name Removed] expressed her displeasure with portions of the job. After meeting with Ms. [Member Name Removed] and as a good faith gesture, a mutual agreement was struck to remove and replace the sidewalk portion of the project only. This was done as agreed upon, with Ms. [Member Name Removed] expressing her happiness with the end product. However, Ms. [Member Name Removed] then began to make further demands that the rest of the project be torn out and replaced. This stood in direct contradiction to the previously made agreement as WarrenCo had already lived up to our portion of the arrangement. Accordingly, WarrenCo refused and asked that Ms. [Member Name Removed] remit final payment for her project. Ms. [Member Name Removed] refused to uphold her end of the agreement. Furthermore, Ms. [Member Name Removed] then took the highly inappropriate steps of contacting her credit card company and having them revoke her deposit that she had previously paid. Ms. [Member Name Removed] states in her review that her credit card company attempted to contact WarrenCo but a return phone call was never received. WarrenCo has reviewed our call logs and voicemails and can find no record of any attempt by Visa to contact us. Therefore, we consider the chargeback for Ms. [Member Name Removed]'s deposit to be fraudulent. Ms. [Member Name Removed] states that equipment was left overnight on her property. This is common in most multi-day projects that involve construction equipment. Ms. [Member Name Removed] claims that the bucket was left in a raised position, filled with rainwater, and came crashing down onto her driveway which resulted in a crack is beyond absurd. The crack that she is referring to was pre-existing to WarrenCo's work ever commencing. Furthermore, the crack showed clearly visible signs of having weathered. This further refutes Ms. [Member Name Removed]'s claim that crack was new. Additionally, any experienced individual who is familiar with hydraulics will be able to attest to the fact that even if the hypothetical falling of the bucket did occur, it would have been a gradual lowering rather than the forceful "crashing" as alleged. In any event, there would have been a sudden loss of hydraulic pressure that would have been evident by hydraulic fluid leaking everywhere. Ms. [Member Name Removed] now stands in breach of contract, has revoked her deposit, refuses to remit payment for the services rendered and is further making preposterous demands that WarrenCo pay her $6,000 for alleged damages. While regrettable, it is at this point that WarrenCo has no choice but to exercise every right to recovery as afforded to us under Indiana statute. Including, but not limited to, placing a lien on Ms. [Member Name Removed]'s property and through litigation to recover the money owed for services rendered and for attorney and court fees. WarrenCo wishes to amicably resolve this matter but is simply unable to stand for the wrongs that have been suffered as the result of Ms. [Member Name Removed]'s ever-increasing demands."
