"TODAY IS FRIDAY, FEBRUARY 28, 2014. WE HAVE HAD AN EXTREME WINTER SEASON, TEMPERATURES HAVE FLUCTUATED BETWEEN -10 degrees TO 55 degrees. Concrete cracks and gives when there are extreme changes in temperature. First, we must state that this project is 18 months old. The fact that this customer has mentioned that the crack appeared on an extremely warm day further supports the fact the temperature has moved between very low and very high temps in a short period of time. The science behind concrete indicates that the material in concrete is subject to shrinkage. The material in concrete in highly sensitive to extreme temperature changes. Our contract with the this customer clearly detailed the science behind concrete. In addition, our contract with the this customer stated "There is no guarantee that concrete will not crack, spall or chip. Concrete contains water, when it dries, it shrinks. Contractor will install wire mesh and rebar to prevent any cracking." It is unfortunate that this situation has arisen. We can sympathize with this customer, but we cannot be held liable for concrete cracking after 18 months."
"It is unfortunate that this situation occurred on this member's project. We have spent countless hours trying to assure this member that we need to wait for the curing process to complete, before we take drastic measures to tear-out and replace these brand new patio pads. We apologize for this member's plight, but we confidently stand firm that this project's colors will balance during the curing process. This process can take up to a year to complete. There are many factors that affect the curing process. Sunlight, moisture and temperature levels/conditions directly affect this process. Slight variations in these levels/conditions will cause a color imbalance. We have promised this member that we will evaluate this patio in the spring. We have promised this member that we will tear out and replace his/her pad, should the color not balance-out at that time. As for the acid staining performed on the rear porch pad, we have have advised this member to contact his home builder to pursue a solution. There were intense chemicals (ie gasoline, heating oil, or solvents) spilled on this pad when the home was being built. We have asked this member to stop blaming us for this problem. We have photographs clearly showing the chemical spill. We found this spill when the pad was completely stripped and re-stained. Again, we apologize for this member's plight, but we have not received any confirmation that this member has asked the builder to rectify this rear porch pad problem. With regards to the schedule, we, at no time, promised this member that we would be able to start his project sooner than we did. Our contract give space for the customer to enter a start date and/or an end date, so that we can accommodate the customer; this member did not enter any dates. He/she should have stated a required project schedule, when he/she executed the contract. We are anxious to resolve all of these issues. The pads have only small cosmetic issues; these issues would not have inhibited this member from enjoying the outside on his/her patio and rear porch pad."
