"It was a pleasure to work with Eric, we hired him for a complete backyard renovation which included tree removal, leveling the surface and place pavers and a deck on top. Also built a retaining wall. The work came out very nice in part because of the great design ideas that Eric gave us. The project ran into some unexpected issues that Eric was able to overcome nicely. We were impressed how Eric handled the project and met all the deliverables, also his team was extremely polite an professional. Our backyard now looks like the ones advertised in magazines. All this led us to start a new project with him to replace the cracked driveway with nice new pavers."

"I have an attached garage with a rooftop deck. Original contract with Ascend was for $54,100 to replace the garage roof and deck, plus repair some damaged drywall in the garage. Additional water damage was discovered, leading to a requirement to have engineering plans created and a permit approved. Cost for the plans was $6,000. Plans were completed, and we asked for an estimated both verbally and via email. Contractor emails demonstrate desire to not provide any estimate. Contractor finally relents and provides a verbal estimate of $25,000 - $35,000 additional cost. This is despite having full engineering plans that they created. Bait and Switch Six weeks pass while the permit is being reviewed. Permit is approved on a Friday, we receive a change order form for $63,000 late on Sunday night, and early Monday morning they show with a crew. This is the start of their pressure campaign. Total cost of the project is now $123,100 including original contract, change order, and engineering plans. More than 2x the original. I reviewed the costs with other contractors who all agreed the additional cost was unreasonable. I asked Ascend to explain the variance to their original estimate versus the change order, their engineering plans, and the permit. While Ascend asserted early on that it was the county that required changes, they could produce no evidence of any pushback from the county. They said that the cost was due entirely to building codes. Throughout they continued to assert many ways where the cost could go higher and that we should expect even more costs. They had the plans, they are supposed to know the building codes, and they had six weeks to amend their estimate. What became clear was they were using the permit as leverage to force me into the higher contract. To their credit, they did acknowledge the sequence of us receiving the change order late at night followed by early morning crew arrival could appear as aggressive and offered us a $10,000 discount if we would do a video promoting them. We declined. Bad Faith Negotiations What followed was a series of events whereby they would agree to an issue, and then quickly renege on the agreement. 1. They initially agreed to split the additional work with another contractor. I have text exchanges with them. We agree on which work Ascend would perform and what other contractors would perform. At their request, I contacted the county to split the permit responsibilities. They also made it clear that they would not honor any warranty on the work they performed if a different contractor's work even touched theirs. For example, if the new contractor's stairs touched their deck (which the stairs is supposed to connect to the deck). 24 hours later they issued a stop work order to me saying that the permit gave them the right to prevent me from engaging other contractors. 2. The later called me to tell me they would call the police on any new contractor I hired. They said they would not do that if I agreed to pay them a fee of $30,000 to allow them to be the general contractor. With the provision that any work they didn't approve of would be torn out and replaced at my expense. At this point I confronted them with the evidence of the bait and switch. I also informed them that I was in contact with the county agency who recommended I ask Ascend to transfer the permit to me. Ascend called me later to say that they would agree to the permit transfer and would settle the original contract. 24 hours later they issue a letter saying they refused to transfer the permit until they could send a settlement agreement. No such settlement agreement was sent. 3. I hired an attorney who issued a Demand Memorandum which required an affirmative response. Ascend never responded and has stopped answering emails, text messages, or phone calls."
